Name Change Through a Divorce Case

Many spouses take on the surname, also known as a “last name,” of his or her spouse after they are married. It is more common for women to adopt their spouse’s surname, however, some men take on their spouse’s surname and sometimes both spouses change their last name to be both last names connected with a hyphen. There are a wide variety of name arrangements which reflect a couple’s new married status. If a couple divorces, a spouse who changed his or her her name is faced with a choice: should he or she revert back to the former surname? It is common for a divorcing spouse to want to use her former surname after the divorce is finalized. Some people want to keep the married surname, even after the divorce, because they want the same surname as their children. The legal documents that commence and finalize the divorce case can contain special language addressing the issue of each spouse’s surname after the divorce is finished. A good Chicago divorce attorney will help you think about the options available in a divorce case.
